A Salem woman who allegedly struck a pedestrian while driving drunk on Atlantic Avenue denied charges in Lynn District Court Friday.
Pamela J. Burns, 56, of 3 Fortune Way, pleaded innocent Friday in Lynn District Court to charges of operating a motor vehicle while under the influence of alcohol, possessing an open container of alcohol in a motor vehicle and negligent operation of a motor vehicle, according to court documents.
According to a police report filed by local officer Rick Alex, at 1:16 p.m., he responded to 397 Atlantic Ave. for a report of a pedestrian struck by a red Isuzu.
When he arrived on scene, Kristin O'Neil-Callahan, 40, of Glendale Road, was reportedly being treated by members of the local fire department. O'Neil-Callahan reportedly suffered a hip injury in the accident.
A witness who had been traveling behind Burns at the time of the accident told police she "had been swerving and braking erratically" and said she was "in the process of calling the police about the erratic operation when she saw the red Isuzu...strike a woman as she crossed the street," according to court documents.
The eye-witness reportedly told police she could see that Burns was on cell her phone at the time of the accident and "did not brake or attempt to avoid the pedestrian" and "showed little reaction even after striking the woman."
Burns, who denied consuming alcohol or taking drugs when questioned, reportedly told police that O'Neil-Callahan "ran out and I hit her," according to court documents.
When police went through her cell phone and saw that she had been making calls while driving, Burns told them she was calling for directions because she was lost and on her way to work at the Jewish Community Center.
When police searched her car, officers reportedly discovered a half-empty 50ml bottle of vodka in the vehicle's center console, an empty 50ml bottle of vodka under the driver's seat and a clear plastic bottle with an unknown substance that "smelled like alcoholic beverage," according to court documents.
After reportedly failing a series of field sobriety tests, Burns registered a blood alcohol content reading of .23% after submitting to a voluntary breath test.
Judge James Wexler released Burns on her own recognizance and ordered her not to drive a motor vehicle. She is scheduled to reappear in court on Oct. 11 for a pretrial hearing.
Your posting a picture of this woman doesn't seem right to me. She has not been convicted. Allegations have been brought. Plus, the grainy effect of the photo almost makes her look like someone on a "Wanted" poster. I don't know her. She may or may not prove her innocence. But I do think putting her photo up for public exposure before she has had her day in court is not warranted.
